terms and conditions

1. Introduction

These Terms & Conditions, together with the Privacy Policy, Refund Policy, and Shipping Policy, govern your use of the Website and purchase of products. “We”, “us”, and “our” refer to Queer Punk, the UK-based business. Please read carefully before placing an order.

2. Definitions

  • Customer means you, the purchaser placing an Order.

  • Goods means any products supplied by us, whether stock or made-to-order.

  • Order means your purchase request as submitted through the Website or via email.

  • Order Confirmation means our email acknowledgment of your Order (not binding).

  • Contract refers to the legally binding agreement formed once the Goods are dispatched.

3. Age and Legal Notice

By placing an order, you confirm you are at least 18 years old and legally permitted to purchase adult products.

4. Orders and Formation of Contract

  • Stock Items – All products listed on the Website as available for purchase are in stock at the time of listing. When you place an order for a stock item and payment is successfully processed. You will receive an order confirmation by email, which will include itemised details, order number, our contact information, and expected shipping details, this is the foundation of the contract.

  • Custom Orders – For bespoke or made-to-order items, a binding contract is formed only when we have agreed in writing with you the final design specification, materials, and total price. Once this agreement is confirmed, work will begin on your order.

  • If, in the rare event of a stock discrepancy, we are unable to fulfil your order, we will notify you as soon as possible and issue a full refund within 14 days of notification.

  • All payments made through our website are processed via a secure third-party payment provider. We do not receive or store your credit or debit card details. By completing a purchase, you agree to the terms and conditions of the payment provider, and a separate contract will exist between you and them. We are not responsible for any errors, actions, omissions, or incorrect charges made by you, or the payment provider.

5. Product Descriptions and Customisation

  • We strive for accurate product descriptions and images but cannot guarantee an exact match, particularly for colours which may vary across screens.

  • Custom-made items may exhibit minor variations or marks—which reflect the handcrafted nature and are not indicative of faults.

6. Pricing and Payment

  • All prices are shown in GBP, inclusive of VAT where applicable, but exclusive of shipping, which is added at checkout.

  • We reserve the right to correct obvious pricing errors even after an Order Confirmation, especially if a mistake is evident.

7. Privacy & Data Handling

  • Legal Compliance

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We only collect and store the personal data necessary to fulfil your order or provide customer service.

  • Data Retention

We do not hold any personally identifiable information for longer than required to meet our contractual and legal obligations (such as accounting or tax requirements).

Once this period has expired, your data will be securely deleted or anonymised.

  • Customer Accounts

If you choose to create an account on our website, we will store your account information (such as name, email address, and order history) until you choose to close your account or request deletion.

You may request account deletion at any time by contacting us directly.

  • Third Parties

We only share your data with trusted service providers (such as payment processors and delivery companies) where necessary to complete your order.

We will never sell your personal information to third parties.

  •  Your Rights

You have the right to access, rectify, erase, or restrict the processing of your personal data. You may also request a copy of the data we hold about you.

8. Refunds & Returns

  • Returns and refunds are handled under our Refund Policy. Please note that bespoke or custom-designed Goods may be non-returnable, unless faulty.

9. Shipping

  • Our shipping terms—including delivery methods, times, costs, and international availability—are detailed in our Shipping Policy.

10. Changes and Updates

  • We may revise these Terms at any time. Any changes apply only to orders placed after the change’s publication. Our Website and Goods may also be updated or withdrawn at any time without prior notice.

11. Limitation of Liability

  • To the fullest extent permitted by law, we exclude liability for indirect, incidental, or consequential damages resulting from your use of the Website or Goods.

12. Governing Law

  • These Terms are governed by English law. Any disputes shall fall under the courts of England and Wales.
